One big problem they will have is that social media posts are fully copyrighted by the poster in most cases, and if they copy that information (say for a report to the employer) in any way, they are guilty of a copyright infringement for each one. Simply because it's on the Internet without a password does NOT grant any license to make copies outside of the established fair use exceptions, which don't seem to cover this sort of activity.

I just learned about this letter that Senators Al Franken and Richard Blumenthal sent to Social Intelligence:

With all due respect, I think the Senators' questions and concerns are misguided. Social Intelligence endeavors to comply with the FCRA and other laws, which provides significant protection for both employers and job candidates. There is much greater risk - and fewer protections - when employers conduct social background checks on their own. Had the Senators (or their staffs) done a bit more research, they would have been able to answer many of the questions on their own and would have then perhaps directed their concerns in more productive and appropriate ways.
